You can make a housing disrepair claim for any of the following.

  • Pests or Vermin (Insect/Mouse Infestation)
  • Leaks, Flooding, Water Damage or another type of Disrepair
  • Defective/Dangerous Electrics
  • Asbestos-Related Issues

In order to claim, you must satisfy the following:

  • Your disrepair problem must be reported to the council or housing association.
  • It must not be caused by the tenant.
  • The council or housing association must have failed to repair.

By law, You CANNOT be evicted for beginning a housing disrepair claim against your landlord or landlady. Please note that there is an exception if you are in arrears and do not have a payment plan in place.

If you do have one in place, even as little as £1 a month is a sufficient amount of protection.

If you are a private renter, the law differs and a landlord or landlady can serve a Section 21 eviction notice which allows landlords to evict tenants without reason.

Campaigns have been put in place to put a stop to this and it’s something we can assess and advise you on. If your landlord or landlady does attempt to evict you, we can still assist you with this.

Unfortunately, because you no longer live at the property you want to claim on, you cannot claim on a former property. In order to be able to make a claim, you have to be living in the property that you want to claim on.
